  1                      A bill to be entitled

  2         An act relating to educational facilities;

  3         creating s. 847.0134, F.S.; prohibiting the

  4         location of adult entertainment establishments

  5         within a specified distance from a school;

  6         providing a criminal penalty; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Section 847.0134, Florida Statutes, is

12  created to read:

13         847.0134  Prohibition of adult entertainment

14  establishment or other adult establishment that displays,

15  sells, or distributes materials harmful to minors within 2,500

16  feet of a school.--

17         (1)  Except for those establishments at locations

18  approved by issuance of a zoning permit or approved by a court

19  order on or before July 1, 2000, an adult entertainment

20  establishment or other adult establishment that sells, rents,

21  loans, distributes, transmits, shows, or exhibits any obscene

22  material as described in s. 847.0133 or presents live

23  entertainment, motion picture, slide, or other exhibit, that,

24  in whole or in part, depicts nudity, sexual conduct, sexual

25  excitement, sexual battery, bestiality, or sadomasochistic

26  abuse and that is harmful to minors as described in s.

27  847.013, may not be located within 2,500 feet of the real

28  property that comprises a public or private elementary school,

29  middle school, or secondary school unless the county or

30  municipality approves the location under proceedings as

31  provided in s. 286.0115.

  1         (2)  A violation of this section constitutes a felony

  2  of the third degree, punishable as provided in s. 775.082 or

  3  s. 775.083.

  4         Section 2.  This act shall take effect July 1, 2000.

  6          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  7                             SB 2066

  8

  9  Deletes opportunity for school boards to submit written
    justification to have the DOE reconsider or revise data
10  related to capital-outlay full-time-equivalent membership for
    construction of schools.
11
    Deletes the four areas of information described in the bill
12  for school districts to use in their written justification to
    the DOE.
