  1                      A bill to be entitled

  2         An act relating to the copyright of

  3         governmental data processing software;

  4         repealing s. 2, ch. 90-237, Laws of Florida;

  5         abrogating the repeal of s. 119.083, F.S.,

  6         which prescribes regulations governing data

  7         processing software and electronic

  8         recordkeeping systems used or created by

  9         governmental agencies; providing for the future

10         repeal of s. 119.083(2), F.S., which authorizes

11         an agency to sell or license copyrighted

12         software to any other public or private entity

13         and establish license fees; providing an

14         effective date.

16  Be It Enacted by the Legislature of the State of Florida:

18         Section 1.  Section 2 of chapter 90-237, Laws of

19  Florida, is repealed.

20         Section 2.  Subsection (2) of section 119.083, Florida

21  Statutes, is repealed October 1, 2006, and shall be reviewed

22  by the Legislature prior to that date.

23         Section 3.  This act shall take effect upon becoming a

24  law.

27                          SENATE SUMMARY

28    Abrogates the repeal of s. 119.083, F.S., which governs
      the licensing and use of copyrighted data processing
29    software and electronic recordkeeping systems by
      governmental agencies. Repeals, effective October 1,
30    2006, s. 119.083(2), F.S., which authorizes governmental
      agencies to hold copyrights to data processing software
31    and establish license fees.
