2 An act relating to public records; exempting
3 information that identifies parents who leave
4 newborn infants at hospitals from public
5 records requirements; providing legislative
6 findings; providing a contingent effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. The identity of a parent who leaves a
12 newborn infant at a hospital or a fire station in accordance
13 with section 383.50, Florida Statutes, is confidential and
14 exempt from the provisions of section 119.07(1), Florida
15 Statutes, and Section 24(a) of Article I of the State
16 Constitution. The identity of a parent leaving a child shall
17 be disclosed to a person claiming to be a parent of the
18 newborn infant. This section is subject to the Open Government
19 Review Act of 1995 in accordance with section 119.15, Florida
20 Statutes, and shall stand repealed on October 2, 2005, unless
21 reviewed and saved from repeal through reenactment by the
22 Legislature.
23 Section 2. The Legislature finds that the preservation
24 of anonymity and confidentiality of parents who leave newborn
25 infants with hospitals will encourage parents to leave infants
26 safely and thus protect the life and health of those infants.
27 The Legislature further finds that the public policy
28 enunciated for the creation of section 383.50, Florida
29 Statutes, will be served if the anonymity of parents who leave
30 newborns with hospitals can be maintained.

1 Section 3. This act shall take effect July 1, 2000,
2 but it shall not take effect unless Committee Substitute for
3 Senate Bill 2080 or similar legislation creating section
4 383.50, Florida Statutes, relating to leaving newborn infants
5 at hospitals is enacted at the 2000 Regular Session or an
6 extension thereof.
