13         Amendment to Amendment (470479) (with title amendment) 

14         On page 40, between lines 26 and 27,

16  insert:

17         Section 9.  Subsection (11) is added to section

18  228.0565, Florida Statutes, to read:

19         228.0565  Deregulated public schools.--

20         (11)  DEREGULATED PUBLIC SCHOOL DISTRICT.--A school

21  district may apply to the State Board of Education to obtain

22  status as a deregulated school district. Such application must

23  be submitted no later than December 1 of the year preceding

24  the proposed implementation and must include:

25         (a)  A resolution of intent, recommended by the

26  district superintendent of schools and approved by a majority

27  plus one vote of the district school board.

28         (b)  A plan which includes, on an aggregate

29  districtwide basis, provisions regarding the requirements of

30  subsections (5), (6), (8), (9), and (10) and the terms and

31  conditions for the operation of the deregulated school

 2         (c)  Requests to the Commissioner of Education for

 3  waivers of statutes considered by the district school board to

 4  be essential to implementation of districtwide deregulation.

 5  Subsequent waivers may be requested pursuant to subsection

 6  (7).

 7

 8  The Commissioner of Education shall provide technical

 9  assistance to a district school board upon written request.

10  The commissioner shall not impose unreasonable regulations

11  that violate the intent of giving school districts greater

12  flexibility to meet educational goals. Status as a deregulated

13  school district shall be for an initial period of up to 5

14  years. Each subsequent renewal shall be for a 5-year period,

15  subject to review and evaluation by the state board and

16  recommendation of the commissioner.
