2 An act relating to management and storage of
3 surface waters; amending s. 373.406, F.S.;
4 exempting the Lake Region Lakes Management
5 District from specified permitting requirements
6 of pt. IV of ch. 373, F.S.; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (9) is added to section 373.406,
12 Florida Statutes, to read:
13 373.406 Exemptions.--The following exemptions shall
14 apply:
15 (9) The Lake Region Lakes Management District, as
16 created by chapter 8378, Laws of Florida, 1919, is exempt from
17 the permitting requirements of this part to the extent
18 described in this subsection. The district is not required to
19 obtain a permit to:
20 (a) Install for lake-level-management purposes up to
21 two 24-inch pipes or their equivalent, which are incorporated
22 with a structure, and are operated based on a water management
23 district's adopted lake-levels program.
24 (b) Remove pipes or other restrictions if such items
25 are too small for or restrict the flow of water in a ditch.
26 (c) Add or change the inverts of pipes located in
27 ditch crossovers when existing crossovers restrict the flow of
28 water in an existing ditch.
29 Section 2. This act shall take effect upon becoming a
30 law.
