  1                      A bill to be entitled

  2         An act relating to management and storage of

  3         surface waters; amending s. 373.406, F.S.;

  4         exempting the Lake Region Lakes Management

  5         District from specified permitting requirements

  6         of pt. IV of ch. 373, F.S.; requiring the

  7         district to provide specified notice upon

  8         undertaking certain project activities;

  9         providing an exception to the exemption;

10         providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Subsection (9) is added to section 373.406,

15  Florida Statutes, to read:

16         373.406  Exemptions.--The following exemptions shall

17  apply:

18         (9)  The Lake Region Lakes Management District, as

19  created by chapter 8378, Laws of Florida, 1919, is exempt from

20  the permitting requirements of this part to the extent

21  described in this subsection. The district is not required to

22  obtain a permit to:

23         (a)  Install for lake-level-management purposes up to

24  two 24-inch pipes or their equivalent, which are incorporated

25  with a water control structure, and are operated based on a

26  water management district's adopted lake-levels program which

27  was created pursuant to this chapter.

28         (b)  Remove pipes, crossovers, or other restrictions

29  located within a ditch if such items are too small for or

30  restrict the flow of water in a ditch.

  1         (c)  Add pipes or change the inverts of pipes located

  2  in ditch crossovers when existing crossovers restrict the flow

  3  of water in an existing ditch.

  5  The Lake Region Lakes Management District shall notify the

  6  Southwest Florida Water Management District when it undertakes

  7  project activities which qualify for an exemption pursuant to

  8  this subsection.  The area within the Lake Region Lakes

  9  Management District that falls under the jurisdiction of the

10  St. John's River Water Management District is not subject to

11  the exemption provided in this subsection.

12         Section 2.  This act shall take effect upon becoming a

13  law.
