17 and insert in lieu thereof:
18 (dd) The home addresses and home telephone numbers of
19 health care practitioners, as defined in s. 455.501(4),
20 working in or with any type of correctional facility,
21 including any prison or jail, or in any forensic mental health
22 facility, who have a reasonable belief that release of the
23 information may be used to threaten, intimidate, harass,
24 inflict violence upon, or defraud the employee, are exempt
25 from the provisions of subsection (1) and s.24(a).Art.I of the
26 State Constitution. The employing and licensing agencies shall
27 withhold the home address and home telephone number from
28 public records requirements only if the health care
29 practitioner submits a written request to the agencies.
30 Section 2. The Legislature finds that it is a public
31 necessity that the home addresses and home telephone numbers

1 of health care practitioners who work in or with any type of
2 correctional facility, including any prison or jail, or in any
3 forensic mental health facility and who have a reasonable
4 belief that release of the information may be used to
5 threaten, stalk, intimidate, harass, inflict violence upon, or
6 defraud the employee or a member of the employee's family, be
7 held exempt from public records requirements because revealing
8 such information may pose an unnecessary risk to the safety
9 and well-being of such health care practitioners in their own
10 homes from inmates or clients of such facilities. The
11 disclosure of such information may also deter health care
12 practitioners from seeking to work or working in such
13 facilities, which would be contrary to the state's interest in
14 ensuring the availability of health care service in such
15 facilities.
