13         Amendment (with title amendment) 

14         On page 2, between lines 10 and 11, of the bill

16  insert:

17         Section 3.  Subsection (4) of section 526.304, Florida

18  Statutes, is created to read:

19         526.304  Predatory practices unlawful; exceptions.--

20         (4)  Notwithstanding any other provision of law to the

21  contrary, in determining whether the sale of motor fuel at a

22  retail outlet is unlawful under this section, the retail sale

23  shall be deemed to be made at the posted pump price, exclusive

24  of any discount received by the purchaser through an in-store

25  retail sales promotion, or that is conditioned upon a required

26  purchase or upon the method or manner of payment, including

27  through the use of a credit card, debit card, or special

28  discount card.  Nothing herein, however, shall authorize any

29  activity or conduct that would otherwise be unlawful under the

30  antitrust laws of the State of Florida or of the United States

31  of America.
