  1                      A bill to be entitled

  2         An act relating to rulemaking authority of the

  3         Department of Veterans' Affairs (RAB); adding

  4         s. 296.06(2)(e), Florida Statutes, providing

  5         certain eligibility requirements for residency

  6         in Florida Veterans' Homes; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Paragraph (e) is added to subsection (2) of

12  section 296.06, Florida Statutes, to read:

13         296.06  State policy; eligibility requirements.--

14         (1)  It is the policy of the state to admit residents

15  into the home without regard to race, age, sex, creed,

16  religion, national origin, or any other reason that would

17  thereby create a practice of discrimination. However, an

18  applicant's veteran status shall not constitute

19  discrimination.

20         (2)  To be eligible for residency in the home, a

21  veteran must:

22         (a)  Have wartime service or peacetime service as

23  defined in ss. 1.01(14) and 296.02.

24         (b)  Have been a resident of the state for 1 year

25  immediately preceding application and be a resident of the

26  state at the time of application.

27         (c)  Not be mentally ill, habitually inebriated, or

28  addicted to drugs.

29         (d)  Not owe money to the department for services

30  rendered during any previous stay at a department facility.

  1         (e)  Have applied for all financial assistance

  2  reasonably available through governmental sources.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
