1 A bill to be entitled
2 An act relating to weapons and firearms;
3 prohibiting the manufacture, importation,
4 distribution, sale, or possession of any
5 military-style weapon; defining the term
6 "military-style weapon"; providing a penalty;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Manufacture, sale, or possession of
12 military-style weapon prohibited; penalty.--
13 (1) A person may not manufacture, import into this
14 state, distribute, sell, offer for sale, give, lend, or
15 possess any military-style weapon.
16 (2) As used in this section, the term "military-style
17 weapon" means:
18 (a) A semiautomatic, centerfire rifle that has the
19 capacity to accept a detachable magazine and any one of the
20 following:
21 1. A pistol grip that protrudes conspicuously beneath
22 the action of the weapon.
23 2. A thumbhole stock.
24 3. A second handgrip.
25 4. A folding or telescoping stock.
26 5. A grenade launcher or flare launcher.
27 6. A threaded barrel capable of accepting a flash
28 suppressor, forward handgrip, or silencer.
29 7. A flash suppressor.
30 (b) A semiautomatic, centerfire rifle that has a fixed
31 magazine with the capacity to accept more than 10 rounds.

1 (c) A semiautomatic, centerfire rifle that has an
2 overall length of less than 30 inches.
3 (d) A semiautomatic pistol that has the capacity to
4 accept a detachable magazine and any of the following:
5 1. A threaded barrel.
6 2. A second vertical handgrip.
7 3. A shroud that is attached to, or partially or
8 completely encircles, the barrel and that allows the bearer to
9 fire the weapon without burning his or her hand, except a
10 slide that encloses the barrel.
11 4. The capacity to accept a detachable magazine
12 outside the pistol grip.
13 (e) A semiautomatic pistol having a fixed magazine
14 that has the capacity to accept more than 10 rounds.
15 (f) A semiautomatic shotgun that has:
16 1. A folding or telescoping stock; and
17 2. A pistol grip that protrudes conspicuously beneath
18 the action of the weapon, thumbhole stock, or vertical
19 handgrip.
20 (g) A semiautomatic shotgun that can accept a
21 detachable magazine.
22 (h) Any shotgun that has a revolving cylinder.
23 (3) Any person who violates this section commits a
24 felony of the second degree, punishable as provided in section
25 775.082, section 775.083, or section 775.084, Florida
26 Statutes.
27 Section 2. This act shall take effect October 1, 2000.

2 SENATE SUMMARY
3 Provides that it is a third-degree felony to manufacture,
import, sell, or possess a military-style weapon. Defines
4 the term "military-style weapon" to include semiautomatic
rifles and pistols that accept detachable magazines and
5 have certain other characteristics and certain
semiautomatic shotguns.
