  2         An act relating to the Miami-Dade County Lake

  3         Belt Plan; amending s. 373.4149, F.S.;

  4         clarifying the boundaries of the plan area;

  5         repealing s. 373.4149(5), F.S.; relating to

  6         requirements on the sale or lease of certain

  7         property or the issuance of a development order

  8         in the plan area; extinguishing any rights that

  9         may have been acquired pursuant to the repealed

10         language, if certain conditions are not met;

11         providing a directive to the Division of

12         Statutory Revision; providing an effective

13         date.

15  Be It Enacted by the Legislature of the State of Florida:

16

17         Section 1.  Subsection (3) of section 373.4149, Florida

18  Statutes, is amended to read:

19         373.4149  Miami-Dade County Lake Belt Plan.--

20         (3)  The Miami-Dade County Lake Belt Area is that area

21  bounded by the Ronald Reagan Florida Turnpike to the east, the

22  Miami-Dade-Broward County line to the north, Krome Avenue to

23  the west and Tamiami Trail to the south together with the land

24  south of Tamiami Trail in sections 5, 6, 7, 8, 17, and 18,

25  Township 54 South, Range 39 East, sections 24, 25, and 36,

26  Township 54 South, Range 38 East less those portions of

27  section 10, except the west one-half, section 11, except the

28  northeast one-quarter and the east one-half of the northwest

29  one-quarter, and tracts 38 through 41, and tracts 49 through

30  64 inclusive, section 13, except tracts 17 through 35 and

31  tracts 46 through 48, of Florida Fruit Lands Company

  1  Subdivision No. 1 according to the plat thereof as recorded in

  2  plat book 2, page 17, public records of Miami-Dade County, and

  3  section 14, except the west three quarters, Township 52 South,

  4  Range 39 East, lying north of the Miami Canal, sections 35 and

  5  36 and the east one-half of sections 24 and 25, Township 53

  6  South, Range 39 East and Government Lots 1 and 2, lying

  7  between Townships 53 and 54 South, Range 39 East and those

  8  portions of sections 1 and 2, Township 54 South, Range 39

  9  East, lying north of Tamiami Trail.

10         Section 2.  Subsection (5) of section 373.4149, Florida

11  Statutes, is repealed.

12  Any rights a person may have acquired pursuant to subsection

13  (5) of s. 373.4149, shall be extinguished six months after the

14  effective date of this act; unless, prior to such date, that

15  person has filed an action in a court of competent

16  jurisdiction to enforce such alleged rights and has recorded a

17  notice of lis pendens.

18         Section 3.    In the next addition of the official

19  Florida Statutes, the Division of Statutory Revision is

20  directed to replace the phrase "six months after the effective

21  date of this act", which appears in Section 2 of this bill,

22  with the date which is six months after the date this bill

23  becomes a law.

24         Section 4.  This act shall take effect upon becoming a

25  law.
