14 On page 76, between lines 7 and 8, of the bill

16 insert:
17 Section 1. Sexual predators secure facility.--
18 (1) The Correctional Privatization Commission created
19 under chapter 957, Florida Statutes, in consultation with the
20 Department of Children and Family Services, shall develop and
21 issue a request for proposal for the financing, design,
22 construction, acquisition, ownership, and leasing of a secure
23 facility of at least 400 beds to house and rehabilitate sexual
24 predators committed under the Jimmy Ryce Act of 1998. The
25 Department of Children and Families shall develop and issue a
26 request for proposal for the operation of the secure facility
27 pursuant to this section. This proviso constitutes specific
28 legislative authorization for the Correctional Privatization
29 Commission to enter into a contract with a provider for the
30 financing, design, construction, acquisition, ownership, and
31 leasing of a secure facility to house and rehabilitate sexual

1 predators to be constructed in Desoto County, Florida.
2 (2) The selected contractor for the financing, design,
3 construction, acquisition, ownership and leasing of the secure
4 facility is authorized to enter into a lease arrangement or
5 other private financing, or to sponsor the issuance of tax
6 exempt bonds, certificates of participation, or other public
7 or private means to finance the facility. The state is
8 authorized to enter into all such agreements as are necessary,
9 including lease alternatives, to bring the facility to an
10 operational state and to commence leasing of the facility.
11 (3) Upon completion of the sexual predator secure
12 treatment facility in Desoto County, the Martin Sexually
13 Violent Predator Treatment and Retaining Program shall be
14 phased out, to be terminated within 1 year of completion of
15 the facility.
