18 Section 48. Sexual predators secure facility.--
19 (1) The Correctional Privatization Commission created
20 under chapter 957, Florida Statutes, in consultation with the
21 Department of Children and Family Services, shall develop and
22 issue a request for proposal for the financing, design,
23 construction, acquisition, ownership, leasing, and operation
24 of a secure facility of at least 400 beds to house and
25 rehabilitate sexual predators committed under the Jimmy Ryce
26 Act of 1998. This proviso constitutes specific legislative
27 authorization for the Correctional Privatization Commission to
28 enter into a contract with a provider for the financing,
29 design, construction, acquisition, ownership, leasing, and
30 operation of a secure facility to house and rehabilitate
31 sexual predators to be constructed in Desoto County, Florida.

1 (2) The selected contractor is authorized to enter
2 into a lease arrangement or other private financing, or to
3 sponsor the issuance of tax exempt bonds, certificates of
4 participation, or other public or private means to finance the
5 facility. The state is authorized to enter into all such
6 agreements as are necessary, including lease alternatives, to
7 bring the facility to an operational state and to commence
8 leasing of the facility.
9 (3) Upon completion of the sexual predator secure
10 treatment facility in Desoto County, the Martin Sexually
11 Violent Predator Treatment and Retaining Program shall be
12 phased out, to be terminated within 1 year of completion of
13 the facility.

27 providing authority for the commission to enter
28 into a contract with a provider; providing
29 authority of the contractor with respect to
30 financing of the project; providing authority
31 of the state to enter into certain agreements;
