18 Section 1. Section 394.47866, Florida Statutes, is
19 created to read:
20 394.47866 State Hospital privatization.--
21 (1) The Department of Children and Family Services
22 shall privatize a state hospital. The department shall plan to
23 begin implementation of this privatization initiative by
24 October 1, 2000.
25 (a) Notwithstanding s. 287.057(12), the department
26 shall enter into agreements, not to exceed 20 years, with a
27 private provider or coalition of providers, to finance,
28 design, and construct a treatment facility having at least 200
29 beds and to operate all aspects of daily operations within the
30 facility. The department shall enter into contracts with the
31 successful provider to commence full operations of the

1 existing hospital by no later than February 1, 2001. The
2 department may subcontract all components of this procurement
3 to a statutorily established governmental entity that has
4 successfully contracted with private companies for designing,
5 financing, acquiring, leasing, constructing, and operating
6 major privatized state facilities.
7 (b) The selected contractor is authorized to sponsor
8 the issuance of tax-exempt bonds, certificates of
9 participation, or other securities to finance the project, and
10 the state is authorized to enter into a lease-purchase
11 agreement for the treatment facility.
12 (2) The contractor shall operate the state hospital as
13 a mental health treatment facility that serves voluntarily and
14 involuntarily committed indigent adults who reside in the
15 state hospital service area.
16 (a) The state hospital shall remain a participant in
17 the mental health disproportionate share program so long as
18 the residents receive eligible services.
19 (b) The department and the contractor shall ensure
20 that the treatment facility is operated as a part of a total
21 continuum of care for persons who are mentally ill. The
22 contractor shall have as its primary goal for the treatment
23 facility to effectively treat and assist residents to return
24 to the community as quickly as possible.
25 (3)(a) State hospital employees who are affected by
26 the privatization shall be given first preference for
27 continued employment by the contractor. The department shall
28 make reasonable efforts to find suitable job placements for
29 employees who wish to remain within the state Career Service
30 System.
31 (b) Any savings that result from the privatization of

1 the state hospital shall be directed to the department's
2 service districts in that hospital's catchment area for the
3 delivery of community mental health services.
4 Section 2. Other contracted mental health treatment
5 facilities at G. Pierce Wood Hospital.--Upon completion of a
6 sexually violent predator treatment facility on the grounds of
7 G. Pierce Wood Hospital, the Martin County sexually violent
8 predator treatment and retaining program shall be phased out,
9 to be completely closed within 1 year.
