13         Amendment (with title amendment) 

14         On page 1, line 25, of the bill

16  insert:

17         Section 1.  Section 30.525, Florida Statutes, is

18  created to read:

19         30.525  Investment of certain bail moneys.--The

20  sheriffs of all counties of the state are hereby authorized to

21  invest all bail moneys collected pursuant to s. 903.16 in

22  interest-bearing accounts. Any interest earned shall be

23  remitted to the county as required by resolution of the board

24  of county commissioners, but not less than on a monthly basis.

25  The county shall use the interest funds received to enhance

26  criminal justice programs within the county.

27         Section 2.  Subsection (1) of section 903.16, Florida

28  Statutes, is amended to read:

29         903.16  Deposit of money or bonds as bail.--

30         (1)  A defendant who has been admitted to bail, or

31  another person in the defendant's behalf, may deposit with the

  1  official authorized to take bail money or nonregistered bonds

  2  of the United States, the state, or a city, town, or county in

  3  the state, equal in market value to the amount set in the

  4  order and the personal bond of the defendant and an

  5  undertaking by the depositor if the money or bonds are

  6  deposited by another.  The sheriff or other officials may

  7  remit money or bonds received to the clerk or county to be

  8  held by the clerk or county pending court action or return to

  9  the defendant or depositor.  The clerk or county shall accept

10  money or bonds remitted by the sheriff. The clerk or county

11  may deposit such moneys or bonds in interest-bearing accounts.

12  Any interest earned shall be remitted to or retained by the

13  county. The county shall use the interest funds received to

14  enhance criminal justice programs within the county.
