  1                      A bill to be entitled

  2         An act relating to the death penalty; amending

  3         s. 921.141, F.S.; providing additional

  4         aggravating circumstances in a capital felony;

  5         providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Paragraph (o) is added to subsection (5) of

10  section 921.141, Florida Statutes, to read:

11         921.141  Sentence of death or life imprisonment for

12  capital felonies; further proceedings to determine sentence.--

13         (5)  AGGRAVATING CIRCUMSTANCES.--Aggravating

14  circumstances shall be limited to the following:

15         (o)  The capital felony was committed while the

16  defendant was engaged in willful violation of an injunction

17  for protection against domestic violence issued pursuant to s.

18  741.30, a foreign protection order accorded full faith and

19  credit pursuant to s. 741.315, an injunction for protection

20  against repeat violence pursuant to s. 784.046, or after any

21  other court-imposed prohibition of conduct toward the victim.

22         Section 2.  This act shall take effect July 1, 2000.

    Revises language with respect to aggravating circumstances in
27  a capital felony to provide that aggravating circumstances
    include cases where the capital felony was committed while the
28  defendant was engaged in willful violation of an injunction
    for protection against domestic violence, a foreign protection
29  order accorded full faith and credit, an injunction against
    repeat violence, or after any other court-ordered prohibition
30  of conduct toward that victim.
