11  Senator Bronson moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 21, between lines 9 and 10,

15

16  insert:

17         Section 12.  Subsection (6) of section 373.406, Florida

18  Statutes, is amended, and subsection (9) is added to that

19  section, to read:

20         373.406  Exemptions.--The following exemptions shall

21  apply:

22         (6)  Any district or the department may exempt from

23  regulation under this part, either by rule or order, those

24  activities that the district or department determines will

25  have only minimal or insignificant individual or cumulative

26  adverse impacts on the water resources of the district.  The

27  district and the department are also authorized to determine,

28  on a case-by-case basis, whether a specific activity should be

29  exempt comes within this exemption.  Requests to qualify for

30  this exemption shall be submitted in writing to the district

31  or department, and such activities shall not be commenced

 1  without a written determination from the district or

 2  department confirming that the activity qualifies for the

 3  exemption.

 4         (9)  Any rule of a district or the department which

 5  existed on October 1, 1995, and which created an exemption

 6  from all or part of the requirements of this part, or the

 7  rules adopted to implement this part, is ratified and

 8  affirmed. However, this subsection does not modify an

 9  exemption in existence on the effective date of this act or

10  limit the authority of a water management district or the

11  department to amend rules adopted under this part or adopt

12  rules creating additional exemptions.
