1 A bill to be entitled
2 An act relating to the Board of Regents;
3 amending s. 240.207, F.S.; providing for
4 appointment of members of the board by the
5 Governor, the President of the Senate, and the
6 Speaker of the House of Representatives;
7 providing for expiration of terms of serving
8 members; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 240.207, Florida Statutes, is
13 amended to read:
14 240.207 Board of Regents; appointment of members;
15 qualifications and terms of office.--
16 (1) The Board of Regents shall consist of the
17 Commissioner of Education and 13 citizens of this state who
18 are shall be selected from the state at large, representative
19 of the geographical areas of the state. Members must; who
20 shall have been residents and citizens of the state thereof
21 for a period of at least 10 years prior to their appointment
22 (one of whom must shall be a member registered as a full-time
23 student in the State University System and who has shall have
24 been a resident resident of this state for at least 5 years
25 prior to appointment in lieu of the 10 years required of other
26 members). Five members, including the student member,; and who
27 shall be appointed by the Governor, approved by three members
28 of the Cabinet, and confirmed by the Senate. Four members each
29 shall be appointed by the President of the Senate and the
30 Speaker of the House of Representatives. However, no appointee
31 shall take office until after his or her appointment has been

1 approved by three members of the Cabinet. The State Board of
2 Education shall develop rules and procedures with which to
3 assure that members represent all regions of the state and for
4 review and approval of the appointees. Except for the
5 Commissioner of Education and except for the full-time student
6 member, who shall serve for 1 year, the terms of office for
7 the members of the Board of Regents shall be 6 years and until
8 their successors are appointed and qualified, except in case
9 of an appointment to fill a vacancy, in which case the
10 appointment shall be for the unexpired term, and except as in
11 this section otherwise provided. No member shall be selected
12 from any county to serve with any other member from the same
13 county, except that not more than two members may be selected
14 from a county which has a population in excess of 900,000, and
15 with the exceptions of the student member, who shall be
16 selected at large, and the Commissioner of Education. The
17 Governor, President of the Senate, and Speaker of the House of
18 Representatives shall fill all vacancies of their respective
19 appointments, subject to the above approval and confirmation,
20 that may at any time occur on the board.
21 (2) Members may be removed for cause at any time upon
22 the concurrence of a majority of the members of the State
23 Board of Education.
24 Section 2. The term of office of each member serving
25 on the Board of Regents on January 2, 2001, expires on that
26 date. The Governor, the President of the Senate, and the
27 Speaker of the House of Representatives shall appoint persons
28 to the Board of Regents for terms beginning on that date. For
29 the purposes of staggering terms of office and providing
30 continuity of membership on the board, of the appointments
31 taking effect on January 2, 2001, the Governor shall appoint

1 the student member for a 1-year term and one member each for
2 terms of 2, 3, 5, and 6 years; the President of the Senate
3 shall appoint one member each for terms of 1, 2, 4, and 6
4 years; and the Speaker of the House of Representatives shall
5 appoint one member each for terms of 1, 3, 4, and 5 years.
6 Thereafter, appointments except that of the student member
7 shall be made for terms of 6 years.
8 Section 3. This act shall take effect upon becoming a
9 law.

12 SENATE SUMMARY
13 Provides that, for terms beginning January 2, 2001, the
Governor shall appoint five members of the Board of
14 Regents, including the student member, and the President
of the Senate and the Speaker of the House of
15 Representatives shall appoint four members each; and the
terms of serving members will expire on that date.
