1 A bill to be entitled
2 An act relating to dissolution of marriage;
3 amending s. 28.101, F.S.; requiring the clerk
4 of the court to collect the amount of and pay
5 premiums on unemployment insurance on certain
6 persons to cover child-support obligations;
7 providing guidelines and establishing a fee;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Paragraph (e) is added to subsection (1) of
13 section 28.101, Florida Statutes, to read:
14 28.101 Petitions and records of dissolution of
15 marriage; additional charges.--
16 (1) When a party petitions for a dissolution of
17 marriage, in addition to the filing charges in s. 28.241, the
18 clerk shall collect and receive:
19 (e) The reasonable premium for a policy of insurance,
20 which shall be forwarded to an authorized insurer or an
21 eligible surplus lines insurer selected pursuant to chapter
22 287, to cover the cost of a policy that will pay child-support
23 amounts owed to the child or the child's legal guardian, after
24 a reasonable waiting period, on behalf of the obligated person
25 if that person becomes involuntarily unemployed due to
26 strikes, lockouts, individual and mass layoffs, or loss of
27 income due to business failure or bankruptcy. Payments under
28 the policy must equal the monthly child-support payments
29 established in the divorce decree and must be payable for the
30 term of involuntary unemployment, not to exceed a total of 13
31 weeks, whether consecutive or not.

1 1. The clerk shall maintain a separate record of all
2 insurance costs, and may collect an additional fee of $4 to
3 cover the administrative cost of handling the insurance
4 premium.
5 2. For the purposes of this paragraph, the office of
6 the clerk of court is considered an agency as defined in s.
7 287.012.
8 Section 2. This act shall take effect July 1, 2000.

12 Requires the clerk of the court to collect unemployment
insurance premiums and pay for unemployment insurance to
13 cover child-support payments if the obligor becomes
unemployed for specified reasons. Provides for a fee.
