1 A bill to be entitled
2 An act relating to water and sewer utilities;
3 amending s. 180.191, F.S.; providing the Public
4 Service Commission with limited jurisdiction
5 over differential rates or surcharges of a
6 municipality providing services outside its
7 boundaries; amending s. 367.022, F.S.;
8 providing an exception to an exemption from
9 Public Service Commission regulation; providing
10 an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (5) is added to section 180.191,
15 Florida Statutes, to read:
16 180.191 Limitation on rates charged consumer outside
17 city limits.--
18 (5) Any municipality that charges rates to customers
19 outside its municipal boundaries which are higher than the
20 rates charged to customers within its municipal boundaries
21 under this section is subject to the jurisdiction of the
22 Public Service Commission to the extent of the difference in
23 rates and must justify the cost of the differential rates,
24 including any surcharges added under this section at a hearing
25 before the Public Service Commission. The appropriate
26 governmental entity that has jurisdiction over the area where
27 customers subject to the higher differential rates including
28 surcharges permitted by this section are located, may appear
29 before the Public Service Commission regarding any proposed
30 differential rates or surcharges under this section.

1 Section 2. Subsection (2) of section 367.022, Florida
2 Statutes, is amended to read:
3 367.022 Exemptions.--The following are not subject to
4 regulation by the commission as a utility nor are they subject
5 to the provisions of this chapter, except as expressly
6 provided:
7 (2) Except as provided in s. 180.191, systems owned,
8 operated, managed, or controlled by governmental authorities,
9 including water or wastewater facilities operated by private
10 firms under water or wastewater facility privatization
11 contracts as defined in s. 153.91, and nonprofit corporations
12 formed for the purpose of acting on behalf of a political
13 subdivision with respect to a water or wastewater facility.
14 Section 3. This act shall take effect upon becoming a
15 law.
