2 An act relating to the definition of "political
3 committee"; amending s. 106.011, F.S.;
4 modifying the definition of "political
5 committee"; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsection (1) of section 106.011, Florida
10 Statutes, is amended to read:
11 106.011 Definitions.--As used in this chapter, the
12 following terms have the following meanings unless the context
13 clearly indicates otherwise:
14 (1) "Political committee" means a combination of two
15 or more individuals, or a person other than an individual, the
16 major primary or incidental purpose of which is to support or
17 oppose any candidate, issue, or political party. For purposes
18 of this subsection, "major purpose" means accepting, which
19 accepts contributions or making makes expenditures which
20 expressly advocate the election or defeat of a candidate or
21 issue during a calendar year in an aggregate amount in excess
22 of $500.; "Political committee" also means the sponsor of a
23 proposed constitutional amendment by initiative who intends to
24 seek the signatures of registered electors. Organizations
25 which are certified by the Department of State as committees
26 of continuous existence pursuant to s. 106.04, national
27 political parties, and the state and county executive
28 committees of political parties regulated by chapter 103 shall
29 not be considered political committees for the purposes of
30 this chapter. Corporations regulated by chapter 607 or chapter
31 617 or other business entities formed for purposes other than

1 to support or oppose issues or candidates are not political
2 committees if their political activities are limited to
3 contributions to candidates, political parties, or political
4 committees or expenditures in support of or opposition to an
5 issue from corporate or business funds and if no contributions
6 are received by such corporations or business entities.
7 Section 2. This act shall take effect upon becoming a
8 law.

Modifies the basic definition of "political committee" to
13 mean a combination of two or more individuals, or a
person other than an individual, the major purpose of
14 which is to support or oppose any candidate, issue, or
political party. Defines "major purpose" as accepting
15 contributions or making expenditures which expressly
advocate the election or defeat of a candidate or issue
16 during a calendar year in an aggregate amount in excess
of $500.
