2 An act relating to the definition of "political
3 committee"; amending s. 106.011, F.S.;
4 modifying the definition of "political
5 committee"; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsection (1) of section 106.011, Florida
10 Statutes, is amended to read:
11 106.011 Definitions.--As used in this chapter, the
12 following terms have the following meanings unless the context
13 clearly indicates otherwise:
14 (1)(a) "Political committee" means:
15 1. A combination of two or more individuals, or a
16 person other than an individual, that in an aggregate amount
17 in excess of $500 during a calandar year:
18 a. Accepts contributions for the purpose of making
19 contributions to any candidate, political committee, committee
20 of continuous existence, or political party;
21 b. Accepts contributions for the purpose of expressly
22 advocating the election or defeat of a candidate or issue;
23 c. Makes expenditures for the purpose of expressly
24 advocating the election or defeat of a candidate or issue; or
25 d. Makes contributions to a common fund, other than a
26 joint checking account between spouses, from which
27 contributions are made to any candidate, political committee,
28 committee of continuous existence, or political party. the
29 primary or incidental purpose of which is to support or oppose
30 any candidate, issue, or political party, which accepts
31 contributions or makes expenditures during a calendar year in

1 an aggregate amount in excess of $500; "political committee"
2 also means
3 2. The sponsor of a proposed constitutional amendment
4 by initiative who intends to seek the signatures of registered
5 electors.
6 (b) Notwithstanding paragraph (a), the following
7 entities shall not be considered political committees for
8 purposes of this chapter:
9 1. Organizations which are certified by the Department
10 of State as committees of continuous existence pursuant to s.
11 106.04, national political parties, and the state and county
12 executive committees of political parties regulated by chapter
13 103 shall not be considered political committees for the
14 purposes of this chapter.
15 2. Corporations regulated by chapter 607 or chapter
16 617 or other business entities formed for purposes other than
17 to support or oppose issues or candidates, are not political
18 committees if their political activities are limited to
19 contributions to candidates, political parties, or political
20 committees or expenditures in support of or opposition to an
21 issue from corporate or business funds and if no contributions
22 are received by such corporations or business entities.
23 Section 2. This act shall take effect upon becoming a
24 law.
