17 Section 11. Subsections (1) and (5) of section
18 235.217, Florida Statutes, are amended to read:
19 235.217 SMART (Soundly Made, Accountable, Reasonable,
20 and Thrifty) Schools Clearinghouse.--
21 (1)(a) The SMART Schools Clearinghouse is established
22 to assist school districts that seek to access School
23 Infrastructure Thrift (SIT) Program awards pursuant to ss.
24 235.2155 and 235.216 or effort index grants pursuant to s.
25 235.186. The clearinghouse must use expedited procedures in
26 providing such assistance.
27 (b) The clearinghouse shall consist of five members
28 who are not members of the Legislature or school district
29 officers or employees and who have substantial business
30 experience in the private sector. Two members shall be
31 appointed by the Governor for initial 1-year and 3-year terms,

1 respectively. One member shall be appointed by the President
2 of the Senate for an initial 2-year term. One member shall be
3 appointed by the Speaker of the House of Representatives for
4 an initial 2-year term. The Commissioner of Education or a
5 designee shall be a member. All subsequent terms of the four
6 appointed members shall be 3 years. The Governor's appointee
7 for the initial 3-year term shall chair the clearinghouse, and
8 each subsequent holder of that position shall serve as the
9 chair.
10 (c) The clearinghouse is assigned to the Department of
11 Education Management Services for administrative and fiscal
12 accountability purposes, but it shall otherwise function
13 independently of the control and direction of the department,
14 except as otherwise provided in chapters 110, 255, and 287 for
15 agencies of the executive branch.
16 (d) The clearinghouse may adopt rules necessary to
17 carry out its duties, including, but not limited to, rules
18 relating to design and performance standards, the SMART
19 Schools Design Directory, project delivery process, and
20 prioritization of SIT Program awards.
21 (5)(a) Members of the clearinghouse are entitled to
22 per diem and travel expenses pursuant to s. 112.061.
23 (b) A member of the clearinghouse shall be subject to
24 the Code of Ethics for Public Officers and Employees, part III
25 of chapter 112.
26 (c) The clearinghouse shall appoint an executive
27 director who shall serve under the direction, supervision, and
28 control of the clearinghouse. The executive director may
29 employ staff, subject to appropriations. The executive
30 director shall serve at the pleasure of the clearinghouse.
31 (d) The clearinghouse shall develop a budget request

1 pursuant to chapter 216. The budget request is not subject to
2 change by the Department of Education Management Services but
3 shall be submitted to the Governor and the Legislature along
4 with the budget request of the department.
5 (e) The clearinghouse and the Department of Education
6 shall develop an interagency cooperation, collaboration, and
7 information-sharing agreement, as necessary to work out areas
8 of mutual concern.
