11  The Committee on Finance & Taxation offered the following:

13         Amendment (with title amendment) 

14         On page 1,

15  remove from the bill:  everything after the enacting clause

16

17  and insert in lieu thereof:

18         Subsection (8) is added to section 125.01, Florida

19  Statutes to read:

20         125.01  Powers and duties.--

21         (8)  Counties are prohibited from levying any impact

22  fee for school purposes in an amount in excess of 37.5% of any

23  school impact fee which that county adopted by county

24  ordinance prior to May 1, 1999.  If the Legislature funds an

25  amount less than 62.5% of the total impact fee revenue in the

26  Appropriations Act, in any year, a county may increase any

27  existing impact fee to make up the difference.

28         Section 2.    Funds appropriated in the General

29  Appropriation Act for the replacement of school impact fees

30  shall be distributed by the Department of Education to school

31  boards on a pro-rata basis based on the amount of school
