13         Amendment to Substitute Amendment (052791) (with title

14  amendment) 

15         On page 211, between lines 23 and 24,

16

17  insert:

18         Section 138.  Notwithstanding section 40 of chapter

19  98-287, Laws of Florida, if a county with a population over 1

20  million on April 1, 1999, according to the official population

21  estimates from the Bureau of Economic and Business Research,

22  University of Florida, or a municipality within that county,

23  adopts an ordinance providing for a local amendment to the

24  Florida Building Code, and such amendment provides a higher

25  level of protection to the public against hurricane winds, as

26  determined by the Florida Building Commission, the local

27  amendment becomes effective without approval of the Florida

28  Building Commission and is not rescinded pursuant to section

29  40 of chapter 98-287, Laws of Florida.

30         Section 139.  Notwithstanding section 40 of chapter

31  98-287, Laws of Florida, if a county or municipality adopts an

 1  ordinance providing for a local amendment to the Florida

 2  Building Code, and such amendment provides for window and door

 3  protection such as hurricane shutters beyond what the code

 4  provides, as determined by the Florida Building Commission,

 5  the local amendment becomes effective without approval of the

 6  Florida Building Commission and is not rescinded pursuant to

 7  section 40 of chapter 98-287, Laws of Florida.
