  1                      A bill to be entitled

  2         An act relating to the Formation of

  3         Municipalities Act; amending s. 165.022, F.S.;

  4         providing that counties operating under a home

  5         rule charter as authorized by s. 6(e), Art.

  6         VIII of the State Constitution may use the

  7         procedures provided by said act or by their

  8         charter for forming or dissolving

  9         municipalities; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Section 165.022, Florida Statutes, is

14  amended to read:

15         165.022  Preemption; effect on special laws.--It is the

16  purpose of this act to provide viable and usable general law

17  standards and procedures for forming and dissolving

18  municipalities in lieu of any procedure or standards now

19  provided by general or special law.  The provisions of this

20  act shall be the exclusive procedure pursuant to general law

21  for forming or dissolving municipalities in this state, except

22  that in those counties operating under a home rule charter

23  which provides for an exclusive method as specifically

24  authorized by s. 6(e), Art. VIII of the State Constitution may

25  use either the procedure provided by this act or the procedure

26  provided in their charter.  Any provisions of a general or

27  special law existing on July 1, 1974, in conflict with the

28  provisions of this act shall not be effective to the extent of

29  such conflict.

30         Section 2.  This act shall take effect upon becoming a

31  law.
