17 Section 8. In order to implement Specific
18 Appropriation 217 of the 2000-2001 General Appropriations Act,
19 paragraph (c) is added to subsection (5) of section 409.905,
20 Florida Statutes, to read:
21 409.905 Mandatory Medicaid services.--The agency may
22 make payments for the following services, which are required
23 of the state by Title XIX of the Social Security Act,
24 furnished by Medicaid providers to recipients who are
25 determined to be eligible on the dates on which the services
26 were provided. Any service under this section shall be
27 provided only when medically necessary and in accordance with
28 state and federal law. Nothing in this section shall be
29 construed to prevent or limit the agency from adjusting fees,
30 reimbursement rates, lengths of stay, number of visits, number
31 of services, or any other adjustments necessary to comply with

1 the availability of moneys and any limitations or directions
2 provided for in the General Appropriations Act or chapter 216.
3 (5) HOSPITAL INPATIENT SERVICES.--The agency shall pay
4 for all covered services provided for the medical care and
5 treatment of a recipient who is admitted as an inpatient by a
6 licensed physician or dentist to a hospital licensed under
7 part I of chapter 395. However, the agency shall limit the
8 payment for inpatient hospital services for a Medicaid
9 recipient 21 years of age or older to 45 days or the number of
10 days necessary to comply with the General Appropriations Act.
11 (c) The Agency for Health Care Administration shall
12 adjust a hospital's inpatient per diem rate to reflect the
13 cost of serving the Medicaid population at that institution
14 if:
15 1. There is a significant change in the mix of patient
16 services, primarily resulting from the effects of a natural
17 disaster occurring after July 1, 2000, which has caused the
18 hospital's average annual Medicaid per-patient cost to
19 increase by more than 25 percent; or
20 2. The hospital experiences an increase in Medicaid
21 caseload by more than 20 percent, primarily resulting from the
22 closure of a hospital in the same service area occurring after
23 July 1, 2000, which has caused the hospital's average annual
24 Medicaid per-patient cost to increase by more than 25 percent.

26 The agency must submit the estimated costs for any adjustment
27 in a hospital inpatient per diem pursuant to the criteria in
28 this paragraph to the Social Services Estimating Conference
29 for its consideration and inclusion in the total estimates for
30 the Medicaid program. Before the agency implements a change in
31 a hospital's inpatient per diem rate pursuant to the criteria

1 in this paragraph, the Legislature must have appropriated
2 sufficient funds in the General Appropriations Act to support
3 the increase in cost as estimated by the Social Services
4 Estimating Conference. This subsection expires July 1, 2001.
