11  The Committee on General Government Appropriations offered the

12  following:

14         Amendment (with title amendment) 

15         On page 10, between lines 13 and 14, of the bill

16

17  insert:

18         Section 1.  Subsection (5) of section 310.151, Florida

19  Statutes, is amended to read:

20         310.151  Rates of pilotage; Pilotage Rate Review

21  Board.--

22         (5)(a)  In determining whether the requested rate

23  change will result in fair, just, and reasonable rates, the

24  board shall give primary consideration to the public interest

25  in promoting and maintaining efficient, reliable, and safe

26  piloting services. The board shall also give consideration to

27  the economic impact of total pilotage costs on the costs of

28  shipping in Florida.

29         (b)  The board shall also give consideration to the

30  following factors:

 1  available to respond promptly to vessels needing their

 2  service.

 3         2.  A determination of the average net income of pilots

 4  in the port, including the value of all benefits derived from

 5  service as a pilot. For the purposes of this subparagraph,

 6  "net income of pilots" refers to total pilotage fees collected

 7  in the port, minus reasonable operating expenses, divided by

 8  the number of licensed and active state pilots within the

 9  ports.

10         3.  Reasonable operating expenses of pilots.

11         4.  Pilotage rates in other ports.

12         5.  The amount of time each pilot spends on actual

13  piloting duty and the amount of time spent on other essential

14  support services.

15         6.  The prevailing compensation available to

16  individuals in other maritime services of comparable

17  professional skill and standing as that sought in pilots, it

18  being recognized that in order to attract to the profession of

19  piloting, and to hold the best and most qualified individuals

20  as pilots, the overall compensation accorded pilots should be

21  equal to or greater than that available to such individuals in

22  comparable maritime employment.

23         7.  The impact rate change may have in individual pilot

24  compensation and whether such change will lead to a shortage

25  of licensed state pilots, certificated deputy pilots, or

26  qualified pilot applicants.

27         8.  Projected changes in vessel traffic, including

28  whether the impact rate change may reduce the number of

29  vessels at the particular port.

30         9.  Cost of retirement and medical plans.

31         10.  Physical risks inherent in piloting.

 1         11.  Special characteristics, dangers, and risks of the

 2  particular port.

 3         12.  The rate of return based on the rate change.

 4         13.  The total cost of pilotage on the cost of shipping

 5  at the particular port compared to the costs at other Florida

 6  ports and other states.

 7         14.12.  Any other factors the board deems relevant in

 8  determining a just and reasonable rate.

 9         (c)  The board may take into consideration the consumer

10  price index or any other comparable economic indicator when

11  fixing rates of pilotage; however, because the consumer price

12  index or such other comparable economic indicator is primarily

13  related to net income rather than rates, the board shall not

14  use it as the sole factor in fixing rates of pilotage.
