15 On page 7, between lines 26 and 27, of the bill

17 insert:
18 Section 1. Paragraph (d) of subsection (3) of section
19 310.0015, Florida Statutes, is amended to read:
20 310.0015 Piloting regulation; general provisions.--
21 (3) The rate-setting process, the issuance of licenses
22 only in numbers deemed necessary or prudent by the board, and
23 other aspects of the economic regulation of piloting
24 established in this chapter are intended to protect the public
25 from the adverse effects of unrestricted competition which
26 would result from an unlimited number of licensed pilots being
27 allowed to market their services on the basis of lower prices
28 rather than safety concerns. This system of regulation
29 benefits and protects the public interest by maximizing
30 safety, avoiding uneconomic duplication of capital expenses
31 and facilities, and enhancing state regulatory oversight. The

1 system seeks to provide pilots with reasonable revenues,
2 taking into consideration the normal uncertainties of vessel
3 traffic and port usage, sufficient to maintain reliable,
4 stable piloting operations. Pilots have certain restrictions
5 and obligations under this system, including, but not limited
6 to, the following:
7 (d)1. The pilot or pilots in a port shall train and
8 compensate all member deputy pilots in that port. Failure to
9 train or compensate such deputy pilots shall constitute a
10 ground for disciplinary action under s. 310.101. Nothing in
11 this subsection shall be deemed to create an agency or
12 employment relationship between a pilot or deputy pilot and
13 the pilot or pilots in a port.
14 2. The pilot or pilots in a port shall establish a
15 competency-based mentor program by which minority persons, as
16 defined in s. 288.703(3), may acquire the skills for the
17 professional preparation and education competency requirements
18 of a licensed state pilot or certificated deputy pilot. The
19 department shall provide the Governor, the President of the
20 Senate, and the Speaker of the House of Representatives with a
21 report each year on the number of minority persons, as defined
22 in s. 288.703(3), who have participated in each mentor
23 program, who are licensed state pilots or certificated deputy
24 pilots, and who have applied for state pilot licensure or
25 deputy pilot certification.
