  1                      A bill to be entitled

  2         An act relating to the Miami-Dade County Lake

  3         Belt Plan; repealing s. 373.4149(5), F.S.,

  4         relating to the disclosure of mining activities

  5         within a specified area; providing for the

  6         extinguishment of any rights acquired under s.

  7         373.4149(5), F.S., as of a specified date

  8         unless such person files a notice of lis

  9         pendens; amending s. 373.4149, F.S.; clarifying

10         the boundaries of the Miami-Dade County Lake

11         Belt Area; providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Subsection (5) of section 373.4149, Florida

16  Statutes, is repealed. However, any rights a person may have

17  acquired pursuant to subsection (5) of section 373.4149,

18  Florida Statutes, shall be extinguished on January 1, 2001,

19  unless, prior to that date, such person files an action in a

20  court of competent jurisdiction to enforce such alleged rights

21  and records a notice of lis pendens.

22         Section 2.  Subsection (3) of section 373.4149, Florida

23  Statutes, is amended to read:

24         373.4149  Miami-Dade County Lake Belt Plan.--

25         (3)  The Miami-Dade County Lake Belt Area is that area

26  bounded by the Ronald Reagan Florida Turnpike to the east, the

27  Miami-Dade-Broward County line to the north, Krome Avenue to

28  the west and Tamiami Trail to the south together with the land

29  south of Tamiami Trail in sections 5, 6, 7, 8, 17, and 18,

30  Township 54 South, Range 39 East, sections 24, 25, and 36,

31  Township 54 South, Range 38 East less those portions of

  1  section 10, except the west one-half, section 11, except the

  2  northeast one-quarter and the east one-half of the northwest

  3  one-quarter, and tracts 38 through 41, and tracts 49 through

  4  64 inclusive, section 13, except tracts 17 through 35 and

  5  tracts 46 through 48, of Florida Fruit Lands Company

  6  Subdivision No. 1 according to the plat thereof as recorded in

  7  plat book 2, page 17, public records of Miami-Dade County, and

  8  section 14, except the west three quarters, Township 52 South,

  9  Range 39 East, lying north of the Miami Canal, sections 35 and

10  36 and the east one-half of sections 24 and 25, Township 53

11  South, Range 39 East and Government Lots 1 and 2, lying

12  between Townships 53 and 54 South, Range 39 East and those

13  portions of sections 1 and 2, Township 54 South, Range 39

14  East, lying north of Tamiami Trail.

15         Section 3.  This act shall take effect July 1, 2000.

17          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
18                             SB 2220

20  Deletes the requirement that Miami-Dade County record certain
    maps and legal description of the Area in the public records
21  of Miami-Dade and Broward Counties;

22  Deletes a requirement that sellors or lessors of property
    located in or within three miles of the Miami-Dade Lake Belt
23  disclose location and the occurrence of blasting within the
    area or be subject to a misdemeanor of the first degree.

    Changes the deadline for preserving rights created under
25  chapter 99-29, L.O.F., to void the sale or lease of property
    from July 1, 2001 to January 1, 2001.
