  1                      A bill to be entitled

  2         An act relating to insurance contract

  3         incontestability; creating s. 627.7265, F.S.;

  4         requiring certain insurance contracts to

  5         provide for incontestability after a time

  6         certain; providing an exception; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 627.7265, Florida Statutes, is

12  created to read:

13         627.7265  Insurance contract incontestability.--Every

14  insurance contract issued under this part shall provide that

15  the policy shall be incontestable after the policy has been in

16  force during the lifetime of any insured for a period of 1

17  year after the date the policy is issued, except for

18  nonpayment of premium.  A renewal policy shall be considered

19  the same as the original policy for purposes of this section.

20         Section 2.  This act shall take effect upon becoming a

21  law.

      Requires motor vehicle and casualty insurance contracts
26    to provide that such contracts are incontestable after
      the policy has been in force during the lifetime of any
27    insured for a period of 1 year after the date the policy
      is issued, except for nonpayment of premium.
