1 A bill to be entitled
2 An act relating to education; creating the Bill
3 of Rights for Florida Students, Teachers, and
4 Parents; providing an effective date.

6 WHEREAS, Article IX, Section 1 of the State
7 Constitution provides that "The education of children is a
8 fundamental value of the people of the State of Florida. It
9 is, therefore, a paramount duty of the state to make adequate
10 provision for the education of all children residing within
11 its borders," and
12 WHEREAS, students, teachers, and parents have certain
13 rights regarding public education which cannot be denied, NOW,
14 THEREFORE,

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. It is the intent of the Legislature that
19 the following principles constitute the Bill of Rights for
20 Florida Students, Teachers, and Parents and serve as the
21 guiding principles toward improving public education:
22 (1) Teachers and students have the right to a safe,
23 secure learning environment.
24 (2) Teachers have the right to teach and students have
25 the right to learn in a classroom that is not overcrowded.
26 (3) Every student has the right to an up-to-date
27 textbook.
28 (4) Teachers and school personnel have the right to
29 confiscate any item they believe can be used as a weapon in a
30 school.

1 (5) Teachers and students have the right to a clean
2 and drug-free learning environment.
3 (6) Teachers have the right to be paid wages at least
4 comparable to the national average for teachers.
5 (7) Teachers have the right to remove any student that
6 is disrupting the classroom.
7 (8) Students have the right of access to a computer to
8 aid in their studies.
9 (9) Teachers and students have the right to schools
10 and classrooms free of discrimination.
11 (10) Parents have the right to become actively
12 involved in their children's education, including attending
13 parent/teacher conferences and participating in school
14 advisory councils.
15 Section 2. This act shall take effect July 1, 2000.
