18         (6)  WAIVER OR VARIANCE FROM LOCAL GOVERNMENT

19  REGULATION.--It is the intent of the Legislature to provide a

20  mechanism by which a farm operation may obtain a waiver or

21  variance from application from local government regulation of

22  a farm activity when such regulation imposes undue hardship on

23  the farm operation. Local governments shall establish

24  procedures and criteria for a waiver or variance from the

25  application of local regulations to a commercial farm

26  operation on land classified as agricultural land pursuant to

27  s. 193.461. A local government shall grant such waiver or

28  variance upon demonstration by the applicant that the activity

29  subject to regulation is in compliance with applicable state

30  and federal requirements, and the following circumstances

 1         (a)  Compliance with the local regulation shall require

 2  measures which, because of their extent or cost, impose undue

 3  hardship on the farm operation.

 4         (b)  Alternative state or federal regulations,

 5  including implementation of best management practices,

 6  substantially achieve the objective of the local regulation.

 7         (c)  The impact of the farm activity on adjacent land

 8  uses, if any, may be be substantially mitigated by

 9  implementation of alternative measures.
