  1                      A bill to be entitled

  2         An act relating to warehouseman liens; amending

  3         s. 677.209, F.S.; providing for a lien on goods

  4         covered by an electronic notification of

  5         receipt; amending s. 671.201, F.S.; providing

  6         that a warehouse receipt is a written receipt

  7         or an electronic notification of receipt;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (1) of section 677.209, Florida

13  Statutes, is amended to read:

14         677.209  Lien of warehouseman.--

15         (1)  A warehouseman has a lien against the bailor on

16  the goods covered by a warehouse receipt or an electronic

17  notification of receipt of such goods or on the proceeds

18  thereof in his or her possession for charges for storage or

19  transportation (including demurrage and terminal charges),

20  insurance, labor, or charges present or future in relation to

21  the goods, and for expenses necessary for preservation of the

22  goods or reasonably incurred in their sale pursuant to law.

23  If the person on whose account the goods are held is liable

24  for like charges or expenses in relation to other goods

25  whenever deposited and it is stated in the receipt that a lien

26  is claimed for charges and expenses in relation to other

27  goods, the warehouseman also has a lien against him or her for

28  such charges and expenses whether or not the other goods have

29  been delivered by the warehouseman.  But against a person to

30  whom a negotiable warehouse receipt is duly negotiated a

31  warehouseman's lien is limited to charges in an amount or at a

  1  rate specified on the receipt or if no charges are so

  2  specified then to a reasonable charge for storage of the goods

  3  covered by the receipt or the electronic notification

  4  subsequent to the date of the receipt.

  5         Section 2.  Subsection (45) of section 671.201, Florida

  6  Statutes, is amended to read:

  7         671.201  General definitions.--Subject to additional

  8  definitions contained in the subsequent chapters of this code

  9  which are applicable to specific chapters or parts thereof,

10  and unless the context otherwise requires, in this code:

11         (45)  "Warehouse receipt" means a written receipt or an

12  electronic notification of receipt issued by a person engaged

13  in the business of storing goods for hire.

14         Section 3.  This act shall take effect October 1, 2000.
