17 Section 1. (1) There is created the State Agency Law
18 Enforcement Radio System Review Panel. The membership of the
19 panel shall consist of three State Senators appointed by the
20 President of the Senate; three State Representatives appointed
21 by the Speaker of the House of Representatives; two members
22 appointed by the Governor; the chairman of the Joint Task
23 Force on State Agency Law Enforcement Communications; and the
24 Director of the Division of Bond Finance within the State
25 Board of Administration. All appointments to the panel must be
26 made by May 19, 2000, or within 30 days after the effective
27 date of this act, whichever occurs later. Members of the panel
28 are not entitled to compensation except for reimbursement, in
29 accordance with section 112.061, Florida Statutes, for travel
30 and per diem expenses associated with official activities of
31 the panel. Such travel and per diem expenses shall be paid by

1 the Department of Management Services.
2 (2) The panel shall review and evaluate a proposal
3 presented to the panel in one or more public meetings by the
4 Department of Management Services to complete the
5 implementation of the statewide law enforcement radio system
6 as authorized by section 282.1095, Florida Statutes. The
7 presentation must be made within 30 days after the successful
8 conclusion of negotiations between the department and the
9 prospective vendor, with the department awarding a contract to
10 the vendor subject to approval of a budget amendment to secure
11 funds for the proposal. The panel shall evaluate whether the
12 proposal provides the best long-term solution for an effective
13 communications system statewide, protects both the investments
14 previously made by the state in developing the system and the
15 future investments to be made, and ensures the optimal value
16 to the state in the future with regard to state resources and
17 assets invested in the system. The panel shall issue a report
18 of its findings and recommendations regarding the proposal,
19 and shall submit the report, within 15 days after the
20 presentation of the proposal by the department, to the
21 Governor, the Speaker of the House of Representatives, the
22 President of the Senate, and the chairperson of the Senate
23 Budget Committee and the House Fiscal Responsibility Council.
24 (3) After presenting the proposal to the review panel,
25 the Department of Management Services may:
26 (a) Recommend to the Board of Trustees of the Internal
27 Improvement Trust Fund that specified state lands and assets
28 associated with the state-agency law enforcement radio system
29 be leased, sold, or otherwise controlled by nonstate entities
30 as part of the proposal.
31 (b) Submit a budget amendment to redirect any funds

1 appropriated specifically for implementation and operation of
2 the radio system in the General Appropriations Act for fiscal
3 year 2000-2001 and the unexpended balances of any prior year
4 appropriations from the State Agency Law Enforcement Radio
5 System Trust Fund as deemed necessary to carry out the
6 proposal, notwithstanding the provisions of sections 216.241
7 and 216.301, Florida Statutes, and pursuant to the provisions
8 of section 216.351, Florida Statutes. Notwithstanding the
9 provisions of section 216.292, Florida Statutes, and pursuant
10 to the provisions of section 216.351, Florida Statutes, such
11 redirection may include establishing new fixed-capital-outlay
12 appropriation categories and may also include transferring
13 funds from fixed-capital-outlay appropriations to
14 operational-appropriation categories.
15 (c) Execute contracts between private vendors and the
16 Department of Management Services which implement the
17 proposal. However, the contracts may not obligate the state to
18 expenditures beyond those which can be met by the unexpended
19 balance of funds specifically appropriated for the law
20 enforcement radio system together with the official projected
21 future revenues of the State Agency Law Enforcement Radio
22 System Trust Fund established by section 282.1095, Florida
23 Statutes. The official projections shall be based on the most
24 recently available forecasts of the Revenue Estimating
25 Conference. Before entering into a contract with any
26 successful bidder, the department shall assure that the
27 contractor's systems are functionally proven, shall undertake
28 a due-diligence review of the contractor's fitness to perform
29 its contracted responsibilities, and shall require that the
30 contractor have an internal system of quality assurance.
31 (4) If the chairpersons of the House Fiscal

1 Responsibility Council and the Senate Budget Committee, or if
2 the Speaker of the House of Representatives and the President
3 of the Senate object to the budget amendment submitted by the
4 department pursuant to subsection (3), in accordance with the
5 provisions of section 216.177, Florida Statutes, the
6 Department of Management Services shall continue to implement
7 the law enforcement radio system as authorized by existing
8 appropriations made by law.
9 (5) The Department of Management Services shall
10 provide adequate staffing for the panel within appropriated
11 staff and resources.
12 (6) The panel is abolished 15 days after the
13 submission of its report, or on March 15, 2001, whichever
14 occurs sooner.
15 Section 2. The sum of $15,000 is appropriated from the
16 General Revenue Fund to the Department of Management Services
17 for fiscal year 1999-2000, and the sum of $15,000 is
18 appropriated from the General Revenue Fund to the Department
19 of Management Services for fiscal year 2000-2001, to be used
20 for travel and per diem expenses incurred by members of the
21 State Law Enforcement Radio System Review Panel.
22 Section 3. This act shall take effect upon becoming a
23 law.
