2 An act relating to law enforcement
3 communications; providing for a review panel to
4 evaluate and select a strategy to complete
5 implementation of the statewide law enforcement
6 radio system; providing for membership and
7 staffing of the panel; providing for the
8 reduction of certain funds appropriated;
9 providing for termination of the panel;
10 providing an appropriation; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. (1) There is created the State Law
16 Enforcement Radio System Review Panel. The membership of the
17 panel shall consist of: three State Senators appointed by the
18 President of the Senate, three State Representatives appointed
19 by the Speaker of the House of Representatives, two members
20 appointed by the Governor, the chairman of the Joint Task
21 Force on State Agency Law Enforcement Communications, and the
22 Director of the Division of Bond Finance within the State
23 Board of Administration. All appointments to the panel must be
24 made by May 19, 2000, or within 30 days after the effective
25 date of this act, whichever is later. Members of the panel are
26 not entitled compensation except for reimbursement in
27 accordance with section 112.061, Florida Statutes, for travel
28 and per diem expenses associated with official activities of
29 the panel. Such travel and per diem expenses shall be paid by
30 the Department of Management Services.

1 (2) The panel shall review, evaluate, and select from
2 among alternative proposals a strategy to complete the
3 implementation of the statewide law enforcement radio system
4 as authorized by section 282.1095, Florida Statutes. The
5 alternative proposals considered must include those developed
6 by the Department of Management Services based on that
7 department's request for proposals issued January 31, 1999.
8 The panel shall select the strategy for completion of the
9 system which provides the best long-term solution for an
10 effective communications system statewide, protects both the
11 investments previously made by the state in developing the
12 system and the future investments to be made, and ensures the
13 optimal value to the state in the future with regard to state
14 resources and assets invested in the system. A strategy must
15 be selected by August 1, 2000.
16 (3) The panel is authorized to recommend to the Board
17 of Trustees of the Internal Improvement Trust Fund that
18 specified state lands and assets associated with the
19 state-agency law enforcement radio system be leased, sold, or
20 otherwise controlled by nonstate entities as part of the
21 implementation strategy selected.
22 (4) Notwithstanding the provisions of chapter 216,
23 Florida Statutes, the panel may redirect any funds
24 appropriated specifically for implementation of Phase III,
25 Phase IV, or Phase V of the radio system in the General
26 Appropriations Act for fiscal year 2000-2001 as deemed
27 necessary to carryout the implementation strategy selected.
28 Such redirection may include establishing new
29 fixed-capital-outlay appropriation categories and may also
30 include transferring funds from a fixed-capital-outlay
31 appropriation to an operational-appropriation category. The

1 Executive Office of the Governor shall prepare and process the
2 necessary budget amendments and fiscal documents as directed
3 by the panel.
4 (5) The panel may approve contracts between private
5 vendors and the Department of Management Services which
6 implement the strategy selected. However, neither the panel or
7 the Department of Management Services may obligate the state
8 to expenditures beyond those which can be met by the funds
9 specifically appropriated for this purpose together with the
10 projected future revenues of the State Agency Law Enforcement
11 Radio System Trust Fund established by section 282.1095,
12 Florida Statutes.
13 (6) The Department of Management Services shall
14 provide adequate staffing for the panel within appropriated
15 staff and resources.
16 (7) The panel is abolished September 1, 2000.
17 Section 2. The sum of $15,000 is appropriated from the
18 General Revenue Fund to the Department of Management Services
19 for fiscal year 1999-2000, and the sum of $15,000 is
20 appropriated from the General Revenue Fund to the Department
21 of Management Services for fiscal year 2000-2001, to be used
22 for travel and per diem expenses incurred by members of the
23 State Law Enforcement Radio System Review Panel.
24 Section 3. This act shall take effect upon becoming a
25 law.

implementation of the statewide law enforcement radio
