1 A bill to be entitled
2 An act relating to law enforcement
3 communications; providing for a review panel to
4 evaluate and select a strategy to complete
5 implementation of the statewide law enforcement
6 radio system; providing for membership and
7 staffing of the panel; providing for the
8 reduction of certain funds appropriated;
9 providing for termination of the panel;
10 providing an appropriation; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. (1) There is created the State Agency Law
16 Enforcement Radio System Review Panel. The membership of the
17 panel shall consist of three State Senators appointed by the
18 President of the Senate; three State Representatives appointed
19 by the Speaker of the House of Representatives; two members
20 appointed by the Governor; the chairman of the Joint Task
21 Force on State Agency Law Enforcement Communications; and the
22 Director of the Division of Bond Finance within the State
23 Board of Administration. All appointments to the panel must be
24 made by May 19, 2000, or within 30 days after the effective
25 date of this act, whichever occurs later. Members of the panel
26 are not entitled to compensation except for reimbursement, in
27 accordance with section 112.061, Florida Statutes, for travel
28 and per diem expenses associated with official activities of
29 the panel. Such travel and per diem expenses shall be paid by
30 the Department of Management Services.

1 (2) The panel shall review and evaluate a proposal
2 presented to the panel in one or more public meetings by the
3 Department of Management Services to complete the
4 implementation of the statewide law enforcement radio system
5 as authorized by section 282.1095, Florida Statutes. The
6 presentation must be made within 30 days after the successful
7 conclusion of negotiations between the department and the
8 prospective vendor, with the department awarding a contract to
9 the vendor subject to approval of a budget amendment to secure
10 funds for the proposal. The panel shall evaluate whether the
11 proposal provides the best long-term solution for an effective
12 communications system statewide, protects both the investments
13 previously made by the state in developing the system and the
14 future investments to be made, and ensures the optimal value
15 to the state in the future with regard to state resources and
16 assets invested in the system. The panel shall issue a report
17 of its findings and recommendations regarding the proposal,
18 and shall submit the report, within 15 days after the
19 presentation of the proposal by the department, to the
20 Governor, the Speaker of the House of Representatives, the
21 President of the Senate, and the chairperson of the Senate
22 Budget Committee and the House Fiscal Responsibility Council.
23 (3) After presenting the proposal to the review panel,
24 the Department of Management Services may:
25 (a) Recommend to the Board of Trustees of the Internal
26 Improvement Trust Fund that specified state lands and assets
27 associated with the state-agency law enforcement radio system
28 be leased, sold, or otherwise controlled by nonstate entities
29 as part of the proposal.
30 (b) Submit a budget amendment to redirect any funds
31 appropriated specifically for implementation and operation of

1 the radio system in the General Appropriations Act for fiscal
2 year 2000-2001 and the unexpended balances of any prior year
3 appropriations from the State Agency Law Enforcement Radio
4 System Trust Fund as deemed necessary to carry out the
5 proposal, notwithstanding the provisions of sections 216.241
6 and 216.301, Florida Statutes, and pursuant to the provisions
7 of section 216.351, Florida Statutes. Notwithstanding the
8 provisions of section 216.292, Florida Statutes, and pursuant
9 to the provisions of section 216.351, Florida Statutes, such
10 redirection may include establishing new fixed-capital-outlay
11 appropriation categories and may also include transferring
12 funds from fixed-capital-outlay appropriations to
13 operational-appropriation categories.
14 (c) Execute contracts between private vendors and the
15 Department of Management Services which implement the
16 proposal. However, the contracts may not obligate the state to
17 expenditures beyond those which can be met by the unexpended
18 balance of funds specifically appropriated for the law
19 enforcement radio system together with the official projected
20 future revenues of the State Agency Law Enforcement Radio
21 System Trust Fund established by section 282.1095, Florida
22 Statutes. The official projections shall be based on the most
23 recently available forecasts of the Revenue Estimating
24 Conference. Before entering into a contract with any
25 successful bidder, the department shall assure that the
26 contractor's systems are functionally proven, shall undertake
27 a due-diligence review of the contractor's fitness to perform
28 its contracted responsibilities, and shall require that the
29 contractor have an internal system of quality assurance.
30 (4) If the chairpersons of the House Fiscal
31 Responsibility Council and the Senate Budget Committee, or if

1 the Speaker of the House of Representatives and the President
2 of the Senate object to the budget amendment submitted by the
3 department pursuant to subsection (3), in accordance with the
4 provisions of section 216.177, Florida Statutes, the
5 Department of Management Services shall continue to implement
6 the law enforcement radio system as authorized by existing
7 appropriations made by law.
8 (5) The Department of Management Services shall
9 provide adequate staffing for the panel within appropriated
10 staff and resources.
11 (6) The panel is abolished 15 days after the
12 submission of its report, or on March 15, 2001, whichever
13 occurs sooner.
14 Section 2. The sum of $15,000 is appropriated from the
15 General Revenue Fund to the Department of Management Services
16 for fiscal year 1999-2000, and the sum of $15,000 is
17 appropriated from the General Revenue Fund to the Department
18 of Management Services for fiscal year 2000-2001, to be used
19 for travel and per diem expenses incurred by members of the
20 State Law Enforcement Radio System Review Panel.
21 Section 3. This act shall take effect upon becoming a
22 law.
