1 A bill to be entitled
2 An act relating to driver's licenses; creating
3 s. 322.2617, F.S.; providing for a notice by
4 certified letter to a person whose driver's
5 license is going to be suspended, disqualified,
6 cancelled, or revoked prior to the suspension,
7 disqualification, cancellation, or revocation;
8 prohibiting suspension, disqualification,
9 cancellation, or revocation for a certain time
10 period; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 322.2617, Florida Statutes, is
15 created to read:
16 322.2617 Driver's license notification required prior
17 to suspension.--In addition to any other requirement provided
18 for in this chapter or in any provision of the Florida
19 Statutes with respect to the suspension, disqualification,
20 cancellation, or revocation of a driver's license other than
21 such actions for driving under the influence, prior to the
22 suspension, disqualification, cancellation, or revocation of a
23 driver's license, the Department of Highway Safety and Motor
24 Vehicles must first send a certified letter to the address on
25 the person's current driver's license, providing that person
26 with a 30-day notice of the reason or reasons for the
27 suspension or revocation together with instructions on what
28 the person may do to avoid the suspension, disqualification,
29 cancellations, or revocation, if possible. No suspension,
30 disqualification, cancellation, or revocation of a driver's

1 license shall take effect until 30 days from the date that the
2 certified letter is delivered.
3 Section 2. This act shall take effect upon becoming a
4 law.

COMMITTEE SUBSTITUTE FOR

9 The CS requires driver's license suspension, disqualification,
cancellation, and revocation notices to be sent by certified
10 mail to the licensee and requires 30-day notice of suspension,
disqualification, cancellation, or revocation.

The CS further provides this provision does not apply to the
12 suspension, disqualification, cancellation, or revocation of a
driver's license for driving under the influence.
