18 Section 6. Section 246.205, Florida Statutes, is
19 amended to read:
20 246.205 Office State Board of Nonpublic and
21 Nontraditional Career Education.--
22 (1) There shall be established in the Division of
23 Administration of the Department of Education the Office a
24 State Board of Nonpublic and Nontraditional Career Education.
25 The office board shall be assigned to the Department of
26 Education only for the purpose of payroll, procurement, and
27 related administrative functions which shall be exercised by
28 the head of the department. The office board shall
29 independently exercise the other powers, duties, and functions
30 originally prescribed to the State Board of Nonpublic Career
31 Education as prescribed by law. The board shall include nine

1 members, appointed by the Governor as follows:
2 (a) One from a business school;
3 (b) One from a technical school;
4 (c) One from a home study school;
5 (d) One from a nonpublic school;
6 (e) Four from business and industry; and
7 (f) An administrator of vocational-technical education
8 from a public school district or community college.
9 (2) Each of the members shall be appointed by the
10 Governor, subject to confirmation by the Senate, for a term of
11 3 years. Of the original members appointed by the Governor,
12 three shall serve for terms of 1 year, three shall serve for
13 terms of 2 years, and three shall serve for terms of 3 years.
14 Of the appointive members from the nonpublic postsecondary
15 career schools, each shall have occupied executive or
16 managerial positions in a nonpublic postsecondary career
17 school in this state for at least 5 years. All members shall
18 be residents of this state. In the event of a vacancy on the
19 board caused other than by the expiration of a term, the
20 Governor shall appoint a successor to serve the unexpired
21 term.
22 (3) The board shall meet at the call of its chair, at
23 the request of a majority of its membership, at the request of
24 the department, or at such times as may be prescribed by its
25 rules.
26 (4) Board members shall be paid travel and subsistence
27 expenses as provided by law while performing their duties
28 under this act.
29 (5) Each board member is accountable to the Governor
30 for the proper performance of the duties of his or her office.
31 The Governor shall cause to be investigated any complaint or

1 unfavorable report received concerning an action of the board
2 or any member and shall take appropriate action thereon. The
3 Governor may remove from office any member for malfeasance,
4 misfeasance, neglect of duty, incompetence, permanent
5 inability to perform official duties, or pleading guilty or
6 nolo contendere to, or being found guilty of, a criminal
7 offense.
