2 An act relating to alimony; amending s. 61.08,
3 F.S.; providing for the award of transitional
4 alimony; defining the terms "permanent
5 alimony," "rehabilitative alimony," and
6 "transitional alimony"; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (1) of section 61.08, Florida
12 Statutes, is amended to read:
13 61.08 Alimony.--
14 (1)(a) In a proceeding for dissolution of marriage,
15 the court may grant alimony to either party, which alimony may
16 be rehabilitative, transitional, or permanent in nature. In
17 any award of alimony, the court may order periodic payments or
18 payments in lump sum or both. The court may consider the
19 adultery of either spouse and the circumstances thereof in
20 determining the amount of alimony, if any, to be awarded. In
21 all dissolution actions, the court shall include findings of
22 fact relative to the factors enumerated in subsection (2)
23 supporting an award or denial of alimony.
24 (b) As used in this subsection, the term:
25 1. "Permanent alimony" means that type of alimony
26 which is awarded for the purpose of providing the receiving
27 spouse with the needs and the necessities of life as they have
28 been established during the marriage.
29 2. "Rehabilitative alimony" means that type of alimony
30 which is awarded only for the purposes of enabling the
31 receiving spouse to become self-supporting through

1 redeveloping existing employment skills, or by receiving
2 training necessary to develop new skills, and of providing
3 support during the rehabilitative period.
4 3. "Transitional alimony" means nonmodifiable alimony
5 that is awarded, for a period of time not to exceed 24 months,
6 for the purpose of covering identifiable, immediate,
7 short-term expenses incurred by the receiving spouse in making
8 an economic transition from married life to single life.
9 Section 2. This act shall take effect July 1, 2000.
