13         Amendment (with title amendment) 

14         On page 3, line 11 through line 20,

15  remove from the bill:  all of said lines

17  and insert in lieu thereof:  performance funds. The

18  commissioner shall consolidate the recommendations and develop

19  a consensus proposal for funding. The Legislature shall adopt

20  a formula and distribute the performance funds to the Division

21  of Community Colleges and the Division of Workforce

22  Development through the General Appropriations Act. The

23  Legislature recognizes that community colleges and school

24  districts must provide programs that are current and meet the

25  demands of business and industry. Therefore, the Legislature

26  intends that the funding formula set forth in this section not

27  penalize institutions which convert out-of-date or low demand

28  programs into high skill/high wage programs as identified by

29  the State Workforce Development Board.  The Legislature also

30  intends that performance exemptions be granted to institutions

31  that start new or significantly expand existing workforce
