1 A bill to be entitled
2 An act relating to health care; amending s.
3 408.039(5), F.S.; providing that hospitals may
4 initiate or intervene in administrative
5 proceedings involving the issuance or denial of
6 a certificate of need for an organ
7 transplantation program within the same service
8 planning area upon a showing that an
9 established organ transplantation program at
10 the hospital will be affected by the
11 certificate of need; providing an effective
12 date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Present paragraph (e) of subsection (5) of
17 section 408.039, Florida Statutes, is redesignated as
18 paragraph (f) and a new paragraph (e) is added to that
19 subsection, to read:
20 408.039 Review process.--The review process for
21 certificates of need shall be as follows:
22 (5) ADMINISTRATIVE HEARINGS.--
23 (e) A hospital may initiate or intervene in an
24 administrative proceeding involving the issuance or denial of
25 a certificate of need for an organ transplantation program
26 upon a showing that an established organ transplantation
27 program at the hospital will be substantially affected by the
28 issuance of the certificate of need to a competing program or
29 facility within the same service-planning area delineated
30 under rules adopted by the Agency for Health Care
31 Administration.

1 Section 2. This act shall take effect upon becoming a
2 law.
