4 on vessels that embark and disembark within the
5 state; providing a penalty; amending s.
6 550.135, F.S.; providing for refunds of certain
7 funds in the Pari-mutuel Wagering Trust Fund;
8 providing an effective date.

10 WHEREAS, it is the intent of the Legislature to
11 prohibit gambling in violation of chapter 849, Florida
12 Statutes, on vessels that operate from ports within this state
13 and that do not make an intervening stop within the boundaries
14 of another state or possession of the United States or a
15 foreign country at which passengers could disembark, NOW,
16 THEREFORE,

18 Be It Enacted by the Legislature of the State of Florida:

20 Section 1. (1) Effective January 1, 2002, a person
21 may not allow gambling activity in violation of chapter 849,
22 Florida Statutes, to be conducted on any vessel that such
23 person manages, supervises, controls, operates, or owns,
24 within or without the waters of this state, if the vessel
25 embarks from this state and disembarks within this state
26 without making an intervening stop in another state or
27 possession of the United States or a foreign country at which
28 passengers could disembark.
29 (2) A person who violates this section commits a
30 felony of the third degree, punishable as provided in section

1 775.082, section 775.083, or section 775.084, Florida
2 Statutes.
3 Section 2. Subsection (4) of section 550.135, Florida
4 Statutes, is amended to read:
5 550.135 Division of moneys derived under this
6 law.--All moneys that are deposited with the Treasurer to the
7 credit of the Pari-mutuel Wagering Trust Fund shall be
8 distributed in the following proportions, in the manner and at
9 the times specified in this section:
10 (4) After payments to the counties have been completed
11 as provided in subsections (1), and (2), and (3), all
12 unappropriated funds in the Pari-mutuel Wagering Trust Fund
13 shall be refunded to permitholders on a pro rata basis
14 deposited to the Treasurer to the credit of the General
15 Revenue Fund as provided in subsection (1).
16 Section 3. This act shall take effect July 1, 2000.
