17 Section 26. Legislative review of the statewide elder
18 care services system and the Medicaid Long-Term Care Nursing
19 Home Diversion Project.--
20 (1)(a) The Legislature, through its jurisdictional
21 committees of both the House of Representatives and the
22 Senate, including the House Elder Affairs and Long-Term Care
23 Committee, the Senate Health, Aging, and Long-Term Care
24 Committee, the House and Senate Appropriations Committees, the
25 House Governmental Operations Committee, and the Senate
26 Governmental Oversight and Productivity Committee, shall
27 review the statewide elder care services system administered
28 by the Department of Elderly Affairs to identify improvements
29 needed with the funding, administration, and delivery of
30 services to Florida's elderly citizens.
31 (b) As part of this review, the Legislature shall

1 assess the progress and the cost-effectiveness of the Medicaid
2 Long-Term Care Nursing Home Diversion Project in assisting
3 frail elderly to age in place. Alternatives to prepaid
4 capitated program and service arrangements shall be explored
5 as part of this review.
6 (2) The chairmen of the two substantive committees are
7 authorized to assemble workgroups, which may include
8 representatives of the department, the Governor's office, the
9 Agency for Health Care Administration, area agencies on aging,
10 service providers, university experts in elder care services,
11 and clients, to review specific aspects of the statewide
12 system. The committees shall report on the findings of the
13 review and make recommendations to the Legislature prior to
14 the beginning of the 2001 legislative session.
15 (3) Funds necessary to support the legislative review
16 shall be provided by the presiding officers to cover the cost
17 of participating House and Senate members and legislative
18 staff responsible for the review.
