17 Section 14. Subsection (7) of section 430.703, Florida
18 Statutes, is renumbered as subsection (8), and a new
19 subsection (7) is added to said section to read:
20 430.703 Definitions.--As used in this act, the term:
21 (7) "Other qualified provider" means an entity
22 licensed under chapter 400 that meets all the financial and
23 quality assurance requirements for a provider service network
24 as specified in s. 409.912, and can demonstrate a long-term
25 care continuum.
26 Section 15. Subsection (1) of section 430.707, Florida
27 Statutes, is amended to read:
28 430.707 Contracts.--
29 (1) The department, in consultation with the agency,
30 shall select and contract with managed care organizations and
31 with other qualified providers to provide long-term care

1 within community diversion pilot project areas. Other
2 qualified providers are exempt from all licensure and
3 authorization requirements under the Florida Insurance Code
4 with respect to their provision of long-term care under a
5 contract with the department.
6 Section 16. A person or entity that arranges for, or
7 makes available to an injured person any product, service,
8 accommodation, or treatment through the use of or by the means
9 of independent contractors, leased employees, leased
10 equipment, or leased facilities shall be deemed a person or
11 institution lawfully rendering or providing such products,
12 services, accommodations, or treatments in accordance with
13 Florida Statutes. This definition is a clarification of
14 existing law and shall be applicable to all claims for any
15 product, service, accommodation, or treatment regardless of
16 when the claim is or was submitted to an insurer for payment.
