1 A bill to be entitled
2 An act relating to substance abuse services;
3 creating s. 397.482, F.S.; directing the
4 Department of Children and Family Services to
5 establish a Gold Seal Quality rating for
6 certain substance abuse treatment programs;
7 providing criteria for designation as a Gold
8 Seal Substance Abuse Treatment Program;
9 requiring the department to reimburse such
10 programs at an enhanced rate; providing for
11 waiver of annual licensure fees; providing for
12 annual reapplication and renewal of the
13 designation; providing conditions for
14 rescinding such designation, the enhanced rate
15 of reimbursement, and the waiver of annual
16 licensure fees; providing an effective date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Section 397.482, Florida Statutes, is
21 created to read:
22 397.482 Gold Seal Quality Substance Abuse Treatment
23 Program.--
24 (1) The department shall develop a two-tiered quality
25 rating system for substance abuse treatment programs. The Gold
26 Seal Quality rating shall be the highest quality rating, and
27 shall be awarded to qualified substance abuse treatment
28 providers pursuant to this section.
29 (2) To receive a separate Gold Seal Quality Substance
30 Abuse Treatment Program designation, and to operate as a Gold

1 Seal Substance Abuse Treatment Program, the following criteria
2 must be met:
3 (a) The program must provide proof of accreditation by
4 the Commission on Accreditation of Rehabilitation Facilities
5 (CARF) or the Joint Commission on Accreditation of Health Care
6 Organizations (JCAHCO), or through any other nationally
7 recognized certification process that is acceptable to the
8 department for those licensable components that are
9 accredited. Programs or components that fail to maintain full
10 accreditation shall be granted a period not to exceed 6 months
11 to achieve full accreditation. The department shall rescind
12 the designation should the program or a component fail to
13 achieve full accreditation at the end of the 6-month period.
14 (b) The program must exceed state target performance
15 criteria specified in its contract with the department and
16 pursuant to s. 216.0166 by 10 percent. The department shall
17 rescind the designation should the program fail to achieve the
18 required level of performance.
19 (c) The program must meet all licensing requirements
20 and standards pursuant to s. 397.403 and department rules.
21 (d) The program must have been issued a regular
22 license pursuant to s. 397.409(3) for at least 5 consecutive
23 years.
24 (3) The department shall establish procedures to
25 reimburse substance abuse treatment programs under contract
26 which hold a Gold Seal Quality Substance Abuse Treatment
27 Program designation at an enhanced rate for substance abuse
28 services provided to individuals who are eligible to receive
29 services from the department. The enhanced rate of
30 reimbursement shall be made available to programs that meet
31 the criteria in paragraphs (2)(a)-(d). The amounts of

1 reimbursement at the enhanced rate shall be provided in
2 performance contracting procedures established by the
3 department and shall be allocated based on the availability of
4 funds. The enhanced rate of reimbursement shall be rescinded
5 by the department for a program which fails to meet the
6 criteria in paragraphs (2)(a)-(d).
7 (4) The department shall waive the annual licensure
8 fee pursuant to s. 397.407 for a program that has achieved a
9 Gold Seal Quality Substance Abuse Treatment Program
10 designation. The waiver shall be rescinded by the department
11 for a program which fails to meet the criteria in paragraphs
12 (2)(a)-(d).
13 (5) The Gold Seal Quality Substance Abuse Treatment
14 Program designation expires at the end of each fiscal year and
15 the program must reapply and provide proof that it meets the
16 criteria described in paragraphs (2)(a)-(d) to renew the
17 designation and receive the enhanced rate of reimbursement for
18 services provided to eligible individuals.
19 (6) The department shall rescind the Gold Seal
20 designation should the program fail to demonstrate compliance
21 with licensure standards as delineated in rules established by
22 the department pursuant to the issuance of regular licenses.
23 Section 2. This act shall take effect July 1, 2000.

Directs the Department of Children and Family Services to
4 establish a Gold Seal Quality rating for substance abuse
treatment programs that meet specified criteria. Provides
5 for designation of such programs as Gold Seal Quality
Substance Abuse Programs. Requires the department to
6 reimburse such programs at an enhanced rate of at least
25 percent above the standard prevailing rate. Provides
7 for waiver of annual licensure fees for such programs,
and for annual reapplication and renewal of the
8 designation. Specifies conditions under which the
department shall rescind the Gold Seal Quality
9 designation, the enhanced rate of reimbursement, and the
waiver of annual licensure fees for a program that fails
10 to meet specified criteria or standards.
