19  be closed. If such records were not exempt, claimants would

20  have unfettered access to information held by the association

21  which could be used as evidence and for purposes of

22  negotiation, claim evaluation, and settlement considerations,

23  which would result in higher awards and settlements paid out

24  by the association and ultimately the consumer. Records held

25  by an internal auditor while an audit is incomplete or while

26  an investigation is pending should be held confidential and

27  exempt because otherwise inaccurate information would possibly

28  be released or investigations jeopardized.
