2 An act relating to trust funds; amending s.
3 20.435, F.S.; creating the Biomedical Research
4 Trust Fund within the Department of Health;
5 providing for sources of moneys and purposes;
6 providing for exemption from the general
7 revenue service charges; providing for annual
8 carryforward of funds; providing for future
9 review and termination or re-creation of the
10 trust fund; providing a contingent effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Paragraph (h) is added to subsection (1) of
16 section 20.435, Florida Statutes, to read:
17 20.435 Department of Health; trust funds.--
18 (1) The following trust funds are hereby created, to
19 be administered by the Department of Health:
20 (h) Biomedical Research Trust Fund.
21 1. Funds to be credited to the trust fund shall
22 consist of funds deposited pursuant to s. 215.5601(4). Funds
23 shall be used for the purposes of the Florida Biomedical
24 Research Program as specified in s. 215.5602. The trust fund
25 is exempt from the service charges imposed by s. 215.20.
26 2. Notwithstanding the provisions of s. 216.301 and
27 pursuant to s. 216.351, any balance in the trust fund at the
28 end of any fiscal year shall remain in the trust fund at the
29 end of the year and shall be available for carrying out the
30 purposes of the trust fund.

1 3. The trust fund shall, unless terminated sooner, be
2 terminated on July 1, 2004.
3 (2) Prior to its scheduled termination pursuant to the
4 provisions of s. 19(f)(2), Art. III of the State Constitution,
5 each trust fund listed in subsection (1) shall be reviewed as
6 provided in s. 215.3206(1) and (2).
7 Section 2. This act shall take effect July 1, 2000, if
8 House Bill 253 or similar legislation is adopted in the same
9 legislative session or an extension thereof and becomes law.
