  1                      A bill to be entitled

  2         An act relating to historic preservation;

  3         creating s. 11.801, F.S.; creating the

  4         Legislative Historic Preservation Commission;

  5         providing for appointment of members, terms,

  6         powers, and duties; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 11.801, Florida Statutes, is

12  created to read:

13         11.801  Legislative Historic Preservation Commission

14  created; powers and duties.--

15         (1)  There is created the Legislative Historic

16  Preservation Commission within the Legislature.

17         (2)  The commission shall be composed of 16 members.

18  Six members of the commission shall be former or present

19  members of the House of Representatives appointed by the

20  Speaker of the House of Representatives and six members of the

21  commission shall be former or present members of the Senate

22  appointed by the President of the Senate. Four members of the

23  commission shall be ex officio members who shall be the Clerk

24  of the House of Representatives, the Sergeant at Arms of the

25  House of Representatives, the Secretary of the Senate, and the

26  Sergeant at Arms of the Senate. Members of the commission

27  shall serve a term which is concurrent with the term of the

28  presiding officer appointing the member to the commission.

29         (3)  Members of the commission shall serve without

30  compensation except that members shall be entitled to receive

  1  per diem and travel expenses while on business of the

  2  commission as provided for in s. 112.061.

  3         (4)  The commission shall meet at least twice annually

  4  at the call of the chair as necessary to fulfill its

  5  responsibilities. The commission shall elect a chair from

  6  among its members. The commission shall, as one of its first

  7  duties, adopt rules of procedure.

  8         (5)  The duties of the Legislative Historic

  9  Preservation Commission include the following:

10         (a)  To serve as an advisory body to the Speaker of the

11  House of Representatives, the President of the Senate, the

12  Division of Historical Resources, and the Division of Library

13  and Information Services of the Department of State with

14  respect to the collection and preservation of the historic

15  records of both houses of the Legislature.

16         (b)  To create a systematic method for the collection

17  and preservation of historic data for both houses of the

18  Legislature working in conjunction with the Division of

19  Historical Resources and the Division of Library and

20  Information Services. The commission shall provide a plan for

21  the collection of historical information which is written,

22  oral, anecdotal, or in the nature of artifacts.

23         (c)  To provide for the availability of the historical

24  information identified by the commission by the most

25  appropriate means available, including the Internet and the

26  programs in chapters 257 and 267.

27         (d)  To assist in the development and provision of

28  educational opportunities which illustrate the historical

29  aspects of the legislative process, utilizing the physical

30  facilities of the House of Representatives, the Senate, the

  1  Historical Capitol, the R.A. Gray Building, and other

  2  appropriate properties.

  3         (e)  To perform such other duties as the commission

  4  shall deem necessary to the historic preservation of the

  5  records of the Legislature.

  6         Section 2.  This act shall take effect upon becoming a

  7  law.
