1 A bill to be entitled
2 An act relating to historic preservation;
3 creating s. 11.801, F.S.; creating the
4 Legislative Historic Preservation Commission;
5 providing for appointment of members, terms,
6 powers, and duties; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 11.801, Florida Statutes, is
12 created to read:
13 11.801 Legislative Historic Preservation Commission
14 created; powers and duties.--
15 (1) There is created the Legislative Historic
16 Preservation Commission within the Legislature.
17 (2) The commission shall be composed of 16 members.
18 Six members of the commission shall be former or present
19 members of the House of Representatives, five appointed by the
20 Speaker of the House of Representatives and one appointed by
21 the Minority Leader of the House of Representatives. Six
22 members of the commission shall be former or present members
23 of the Senate, five appointed by the President of the Senate
24 and one appointed by the Minority Leader of the Senate. Four
25 members of the commission shall be ex officio members who
26 shall be the Clerk of the House of Representatives, the
27 Sergeant at Arms of the House of Representatives, the
28 Secretary of the Senate, and the Sergeant at Arms of the
29 Senate. Members of the commission shall serve a term which is
30 concurrent with the term of the presiding officer appointing
31 the member to the commission.

1 (3) Members of the commission shall serve without
2 compensation except that members shall be entitled to receive
3 per diem and travel expenses while on business of the
4 commission as provided for in s. 112.061.
5 (4) The commission shall meet at least twice annually
6 at the call of the chair as necessary to fulfill its
7 responsibilities. The commission shall elect a chair from
8 among its members. The commission shall, as one of its first
9 duties, adopt rules of procedure.
10 (5) The duties of the Legislative Historic
11 Preservation Commission include the following:
12 (a) To serve as an advisory body to the Speaker of the
13 House of Representatives, the President of the Senate, the
14 Division of Historical Resources, and the Division of Library
15 and Information Services of the Department of State with
16 respect to the collection and preservation of the historic
17 records of both houses of the Legislature.
18 (b) To create a systematic method for the collection
19 and preservation of historic data for both houses of the
20 Legislature working in conjunction with the Division of
21 Historical Resources and the Division of Library and
22 Information Services. The commission shall provide a plan for
23 the collection of historical information which is written,
24 oral, anecdotal, or in the nature of artifacts.
25 (c) To provide for the availability of the historical
26 information identified by the commission by the most
27 appropriate means available, including the Internet and the
28 programs in chapters 257 and 267.
29 (d) To assist in the development and provision of
30 educational opportunities which illustrate the historical
31 aspects of the legislative process, utilizing the physical

1 facilities of the House of Representatives, the Senate, the
2 Historical Capitol, the R.A. Gray Building, and other
3 appropriate properties.
4 (e) To perform such other duties as the commission
5 shall deem necessary to the historic preservation of the
6 records of the Legislature.
7 Section 2. This act shall take effect upon becoming a
8 law.
